1. Who provides this service
StarCut Optimizador ("Optimizador", "the Service") is operated by FERCAM LLC, an entity currently being formed in the state of Arizona, United States ("FERCAM", "we", "the Operator").
2. What Optimizador is
Optimizador is a web tool for woodworking, melamine/MDF, sheet metal, and aluminum profile shops that, based on the dimensions of your pieces, calculates the arrangement with the least possible waste across boards, sheets, or profiles, and generates a cutting plan and materials list ready to print or export.
Optimizador is offered in two tiers:
- Free plan: piece capture, cutting plan calculation, and export (PDF/CSV/SVG/PTX), running entirely in your browser.
- PRO plan (paid): everything above, plus additional features such as cloud project storage (when available), priority support, and continuous access to cutting engine improvements.
3. Your account and eligibility
To use the Free plan you don't need to create an account: Optimizador runs locally in your browser. For the PRO plan, we use your email address as the identifier for your subscription (see our Privacy Policy). You must be at least 18, or the age of legal majority in your jurisdiction, to purchase the PRO plan, since it involves a recurring charge.
You are responsible for keeping the email address associated with your subscription confidential and for any activity under your account.
4. Subscription, pricing, and billing
The PRO plan is billed as a recurring monthly subscription, processed by Lemon Squeezy, who acts as the Merchant of Record (meaning Lemon Squeezy is the party that legally charges you, issues the applicable receipt, and handles taxes such as VAT/sales tax). StarCut never sees or stores your full card details.
The current price is always shown before you confirm payment, inside Lemon Squeezy's checkout. We may update the PRO plan price going forward; any price change does not affect a cycle you've already paid for, and for existing subscriptions we'll notify you by email at least 15 days before the next charge.
The subscription renews automatically every month until you cancel it. We do not currently offer annual plans.
5. Cancellation
You can cancel your PRO subscription at any time, with no penalty and no minimum commitment, from the subscription management link Lemon Squeezy emails you when you sign up, or by writing to hola@starcut.app.
When you cancel, you keep PRO access until the end of the period you already paid for. After that date, your account automatically reverts to the Free plan (you won't be charged again).
6. Your data and projects
You own all the data and cutting projects you upload or create in Optimizador (measurements, materials, generated plans, purchase lists). We claim no ownership over your content.
Today, Optimizador processes and stores your projects locally in the browser you're using (via localStorage): they are not uploaded to our servers unless you explicitly enable a cloud-save feature once available for the PRO plan. This means that, today, if you clear your browser data or switch devices without exporting your project, we don't have a copy to restore — we recommend exporting important projects regularly.
You grant us a limited, non-exclusive license to process your data solely to generate the cutting plan and the Service features you request — never to train third-party models or for purposes other than operating Optimizador.
7. What happens if you cancel or stop using Optimizador
Since your projects live in your own browser (see section 6), cancelling your PRO subscription does not delete anything locally — you keep access to your projects saved in that browser under the Free plan.
For data that does live on our servers (your email and subscription status, and in the future, cloud-saved projects if you enable that feature):
- We retain your email and billing history for as long as the law requires for accounting/tax purposes.
- Cloud-saved projects (future feature) are retained for 30 calendar days after cancellation, in case you change your mind and want to reactivate your PRO plan without losing your work. After that period, they are permanently and irrecoverably deleted from our servers.
- You can request early deletion of any of this data at any time by writing to hola@starcut.app (see also your rights in our Privacy Policy).
8. Acceptable use
By using Optimizador you agree not to:
- Attempt unauthorized access to other accounts, our infrastructure, or other users' data.
- Use the Service for illegal activities or to infringe on third-party rights.
- Reverse-engineer the optimization engine in order to build a directly competing product from our code.
- Deliberately overload our infrastructure (aggressive scraping, abusive automation, etc.).
9. StarCut's intellectual property
The software, design, the "StarCut" brand, the cutting optimization engine, and all platform code are the property of FERCAM LLC (or its founder, while formation is completed — see section 1) and are protected by intellectual property laws. This does not include your own data and projects (see section 6).
10. Availability and warranties
We work to keep Optimizador available and functioning correctly, but the Service is provided "as is," without warranties of uninterrupted availability, absence of errors, or that the optimizer's output will be perfect for every particular use case. Optimizador is a support tool: final responsibility for cutting and material purchasing decisions remains yours.
11. Limitation of liability
To the maximum extent permitted by applicable law, FERCAM LLC (or its founder, while formation is completed) will not be liable for indirect, incidental, special, or consequential damages (including loss of material, production time, or profits) arising from the use or inability to use Optimizador. Our total aggregate liability to you, for any claim related to the Service, will not exceed the amount you paid for your PRO subscription during the 3 months prior to the event giving rise to the claim.
12. Changes to these terms
We may update these Terms occasionally (for example, when launching new features or due to regulatory changes). We will post the "last updated" date above and, for material changes affecting your rights, notify you by email or via a visible notice in the app at least 15 days in advance.
13. Governing law
These Terms are governed by the laws of the state of Arizona, United States, without prejudice to any non-waivable rights that the consumer protection law of your country of residence (for example, Mexico) may grant you, which prevail where mandatorily applicable.
